Terms & Conditions of Occupancy
 

NOTICE: All properties represented by Dream Vacation Cabins (DVC) are individually owned and furnished to the needs of the owner. Owner's personal property must be respected. DVC represents the owner(s) of the property(s) in a client/agency relationship. The terms Guest(s) & Tenant(s) are used interchangeably and are defined as the principal party(s) renting a vacation property & those accompanying the principal party. Please Review Terms and conditions of occupancy as these terms apply to all properties. Terms and Conditions are not subject to any modification.
 
ALL RESERVATION CONFIRMATIONS CONTAIN THE FOLLOWING: 

Total Rental Rate (plus pet fee if applicable) 
NC state tax adds 6.75% to the total charges. Rutherford County tax '
of 5% Total 11.75% 
Security Deposit Protector $45.99 for each rental 
Reservation fee of $75-$125 charged on each rental (rate depends
on which rental)
Departure Cleaning Fee Included in rent 
Additional charge of $10.00, for Rollaway Bed/Portacrib
 
1. RESERVATION DEPOSIT: Reservations require an initial 50% of the total amount due which is applied toward the entire reservation. Upon receipt of initial reservation deposit, a confirmation will be emailed to the principal party named on the reservation.
2. PAYMENT/BALANCE DUE: Final payments are due no later than 30 days prior to arrival. Mark your calendar as NO INVOICE OR REMINDER WILL BE SENT FOR THE FINAL PAYMENT.  All funds received are deposited in a trust account until disbursement.
3. CLEANING FEE: Cleaning fees are included in rates. Guests are responsible for leaving the property in good order before departure.  Guest shall leave all doors and windows locked and make sure the heat is set at 55, air conditioning is set on 78 and lights are turned off upon checkout. With limited time available between guests, guest is required to complete the following:

Return furniture to original locations. 
Wash and put away all dishes including those in dishwasher.
Remove all opened food and trash from home.
Place trash in sealed plastic bags in proper receptacle(s). 
Appliances, counters and other surfaces must be wiped clean. 
Carpets and floors are to be broom cleaned of excessive debris. 
Failure to complete the above will result in extra charges plus applicable taxes that    will be charged to Guests account.

4. DAMAGE : All confirmations will show an optional Security Deposit Protector fee of: $45.99. The SDP is intended to protect guests from costs incurred due to accidental damages or theft to the leased premises during occupancy. In order to administer claims, DVC must be notified during occupancy and prior to check-out of any accidental damage or theft. A full description of the SDP is included with confirmations.
5. SECURITY/DAMAGE DEPOSIT: Security Deposit Protector Fee of $45.99 is charged on each rental. Please report any problems or damages observed in the rental property upon check-in. Unreported problems and /or damages are assumed to have occurred during occupancy and guest shall be held responsible for those damages.
6. RESERVATION FEE: All reservations require a NON-refundable $75-$125 Reservation Fee depending on which rentalyou choose..
7. CANCELLATIONS: If a confirmed reservation is cancelled a processing fee of $50.00 will be charged against the Advanced Confirmation Deposit. If the cancellation occurs 30 days prior to arrival, all funds received will be forfeited, unless the property can be re-rented for the cancelled period. Please allow 30 days from the date we receive your cancellation notice for any of the Advance Confirmation Deposit to be returned, (applicable only if the unit was re-rented)
8. CHANGING/TRANSFERRING RESERVATIONS: Any change or transfer of a confirmed reservation within the same property is subject to a $75.00 Change/Transfer fee & property owner approval. Changes from one property to another are subject to our cancellation terms & conditions.
9. PETS: MOST PROPERTY OWNERS DO NOT ALLOW OR ACCEPT PETS due to owner preference or allergy concerns. If pets are allowed, there is a non-refundable pet fee of $100/pet plus tax. No pets are allowed without DVC pet agreement signed in advance of arrival. If pets are allowed, all pets must be kept on rental property. Guests must abide by all local pet regulations and leash laws. DVC reserves the right to charge guest's security deposit or bill guest for any pet related damage or cleanup of pet debris upon departure. Guests (including visitors and day guests) who bring pets to non-pet properties will be subject to pet fees, additional cleaning fees and possible removal from the property without refund.
10. METHOD OF PAYMENT: All rates quoted by DREAM VACATION CABINS are amounts payable by cash, check, money order, or credit card in U.S. funds. Dream Vacation Cabins accepts MasterCard and Visa credit cards.
11. CHECK-IN TIME (3PM-5PM): Check-ins take place at the Dream Vacation Cabins office on 1840 Memorial Hwy., Lake Lure, NC. between 3:00-5:OOPM. Sorry, early Check-Ins are NOT available. Please schedule arrivals accordingly. If a guest is to arrive after 5:OOPM, call for special instructions for picking up your keys. DVC cannot provide a late check-in if tenants have a balance due. Guests shall not proceed to the rental property, including driveways, beaches or docks prior to 3 p.m. Check-In. Keys are not released until 3 p.m. on the day of arrival.
12. CHECK-OUT TIME (11AM): Check-Out and vacating the property on the day of departure is 11:00 a.m. Guest will be charged one additional day rental if property is not vacated by Check-Out time. All property keys must be returned to our office. There is a $25.00 charge to principal party for lost, missing or keys not returned to DVC by 11:30 a.m. on day of departure. Fees for non-returned keys will be charged to guest.
13. TRASH REMOVAL: Guests are responsible to place SEALED, BAGGED trash in containers for trash removal. Trash must be sealed and bagged in plastic trash bags and left in designated area in supplied containers. Trash not sealed and placed in plastic bags or in designated areas will result in charges to guests. Individual property owners arrange for trash removal services. Some of the rentals trash will have to be taken to the convience center located on Bill's Creek Road. Riverbend guests: Trash must be left in the dumpsters
14. DEPARTURE REQUIREMENTS: The rental property is to be left generally clean with bagged trash removed and stored in trash receptacles provided by the owner and taken to designated pick-up areas. All kitchen equipment and utensils are to be cleaned and stored. All floors are to be broom clean. Any beds used should have all dirty linens removed from bed and placed in the bathtub.  Rental items should be left as required by DVC.
15. SUBLETTING PROHIBITED: Guest acknowledges that the rental property may not be sublet. Subleasing shall immediately void any rental agreement with no refund due to guest.
16. GUEST/OCCUPANCY: We prefer family groups and qualified adults. Vacation properties are limited to the maximum occupancy as stated in the confirmation provided with these terms of occupancy. Overnight guests (8:00 p.m. - 8:00 a.m.) are limited to the maximum occupancy limits and includes all adults and children.
17. HOUSE PARTIES/LARGE GATHERINGS: House parties and large gatherings exceeding maximum occupancy are prohibited and may result in guest's immediate removal.
18. QUIET HOURS: For guest's enjoyment and the enjoyment of others, please respect quiet times between 9PM and 8AM.
19. PARKING: Parking is limited. The number of vehicles each property will accommodate is stated on tenant's confirmation. Excess vehicles on property are subject to removal at tenant's expense.
20. ITEMS NOT SUPPLIED: Extra blankets and pillows are not supplied by DVC.
21. RENTAL ITEMS: We have a rollaway bed and a portacrib available for an additional charge. Prior arrangements must be made.
22. ACCOMMODATIONS: Accommodations range from luxury homes to very basic cottages. All properties are privately owned, individually furnished and equipped for housekeeping with basic items such as pillows, bed linens, towels, blankets, cookware, flatware and dishes. Other small appliances, beach chairs, radio, fans, etc., may or may not be provided. Dream Vacation Cabins is unable to provide additional furnishings or appliances.
23. WATER POTABILITY: Rental properties have varying water quality, and are different than most guests are accustomed to drinking at home. Most of the rentals are either on a well or city water.
24. CAMPERS/MOTOR HOMES/TENTS: Campers, motor homes or the use of tents on rental property is prohibited. Sorry, no exceptions.
25. TELEVISIONS: Most rental properties are equipped with TV's. When TV's are provided, they are listed on the property listing sheet. Reception in the Lake Lure is very limited and available only with cable or
satellite service. Cable service varies from (basic 1 0 +/- channels) to (expanded 40 +/- channels) depending on what package owner purchased for their rental.
26. TELEPHONE SERVICES/COMPUTER ONLINE USE: Some properties are equipped with telephones for local calls only. They are not setup for computer usage. Long distance calls must be charged to guest's credit card, calling card or made on a collect basis. No dial-up for computers. 
27. GAS (if tank is empty) AND CHARCOAL MUST BE PROVIDED BY GUEST. DVC can provide a list of local filling stations. Outdoor cooking is allowed, but only in U/L approved grills. ALL cooking surfaces must be left clean by guest upon departure to avoid extra cleaning charges.
28. CAMPFIRES: Campfires are prohibited. SORRY. NO EXCEPTIONS.
29. MECHANICAL & APPLIANCE FAILURE: DVC will use its best efforts to have mechanical (water, septic, electrical and plumbing) and appliance failures corrected as soon as possible, but cannot control the scheduling of outside service contractors. NO REFUNDS will be made for appliance(s) or mechanical failures or breakdowns. DVC shall have the right to arrange, inspect and make repairs during rental period. Tenant will be charged for unnecessary maintenance and service calls or repairs caused by abuse beyond normal wear and tear. NO refunds will be made for the malfunction of appliances or other equipment.
30. BEACH SIZE/LAKE LEVELS & INCLEMENT WEATHER: From Winter to Spring, major lake levels vary up to two (2) feet. Town controlled lake levels may affect beach size, launching area and water depths. SORRY, NO REFUNDS WILL BE MADE FOR INCLEMENT WEATHER. CHANGES IN BEACH SIZES, LAUNCHING AREAS OR WATER DEPTHS.
31. CONSTRUCTION: As our area continues to grow, we cannot predict when or where new construction will begin. DVC has no control in these situations, and cannot move or offer refunds on confirmed reservations if construction occurs near the property being occupied for rental purposes.
32. PROPERTY RESERVED: Each rental property is privately owned and reflects the owner's personal taste. Each property is represented by DVC as realistically as possible with regard to space, physical size and comparison.
33. COMMUNITY RULES/REGULATIONS: Some individual communities and associations have rules and regulations that become part of the guests Terms and Conditions of Occupancy. Community rules that apply are provided to tenant at check-in or may be requested prior to occupancy.
34. UNFORESEEN CIRCUMSTANCES: If the rental property becomes unavailable or uninhabitable, DVC reserves the right to move a guest to a comparable location accommodating the same number of persons and within the same price range. DVC cannot guarantee availability or comparability of other properties. Owner and DVC are not liable for any acts of nature or major mechanical failure that would prohibit or limit the use of a property.
35. ERRORS & OMISSIONS: DVC has taken great effort to ensure the information in our brochure, website and all of our printed material are accurate. We cannot be held responsible for errors, omissions, or change in prices. All rental properties are privately owned and their furnishings vary depending upon the owners' taste. Dream Vacation Cabins, cannot guarantee the presence of particular listed furnishings because they may change from time to time depending on the owner's taste.
36. LIABILITY: Guest(s) hereby agree(s) to hold and save harmless Dream Vacation Cabins, their employees, and the property owner from damages or injuries to personal property by reason of any cause whatsoever, either in or about the occupied property or elsewhere.
37. AGENCY DISCLOSURE: Dream Vacation Cabins, represents the propertyowner(s). DVC will make every effort to assist guest(s). DVC is a vacation home rental company and the management of the property is the sole responsibility of trie Uwner(s).
38. GUEST RESPONSIBILITY: The guest whose name appears on the confirmation is responsible for all terms and conditions set forth in this document for them, their guests or others they may have visiting or staying at the vacation rental property during their term of occupancy.
39. VIOLATION OF TERMS OR CONDITIONS OF OCCUPANCY: When Guest(s) violate(s) any of the terms of occupancy, property rules, community rules or regulations, the guest(s) may be asked to vacate the property by Dream Vacation Cabins and NO refund will be due to guest(s).

GUEST AGREES TO ABIDE BY THESE TERMS OF OCCUPANCY UPON TENDER OF ANY PAYMENT. PVR. INC. AGREES TO MAKE PROPERTY AVAILABLE SUBJECT TO THIS DOCUMENT AND RENTAL CONFIRMATION SUPPLIED TO GUEST.
